Should charges be filed as hit and run that resulted in a death?

My son's father was killed by a driver on March 11, 2008 in San Antonio, Texas (Bexar County) while walking home. There are so many conflicting information regarding his death it truly saddens me. He did not have identification on him so we believe his accident was truly mishandled. There are different stories to what happened. There's the police report which makes absolutely no sense. The police reports states he was crossing the street and he was hit basically. He knew this area like the back of his hand and would not have been crossing the street at that spot. He lived on the side of street he was walking so there was no reason for him to be crossing. Long story short. Witnesses and news report states he was hit from behind and thrown back into traffic. He was then run over by two other vehicles. The police report does not reflect any of that information. The driver of the vehicle DROVE OFF (that wasn't doented on the report) and went down the rode about 3/4 mile. Supposively to get in a safer location. He could have pulled right over by the accident and still be in a safe spot considering the location where he hit him was for vehicles to pull over. He never stopped or came back to render aid. Other witness pulled over to help. One witness said he was on his cell phone and went off rode and hit him. NONE of the witness cards were every turned in with the police report. Nothing ever happened to the young man who hit him who was driving a vehicle not registered to him and he was driving with a suspended/revoked license. HE WASN'T EVEN TICKETED FOR THAT. None of this is making sense to me. Why didn't he go to jail let alone get a ticket? NO breathalizer was performed. This was a fatality. Pictures were taken, but they were never turned in. 3 weeks after the accident the DA still hadn't received the accident report. There is so much missing regarding this accident. I feel it was a hit and run that resulted in a death and was swept under the rug. The police report is not accurate. No one is being held responsible for his death. This was a wrongful death.
