Does rare own donkey kong?

i was reading up on rare, a gaming company, that when they got bought out by microsoft, that they still, in some ways, own donkey kong. i call pure bullcrap. nintendo had the mascot for years and i dont know why rare has to say that. but im thinking rare does own the donkey kong contry series. if thats true, why? why hasent nintendo made another DKC game?
